Terms of Service

1. What Launching Desk is

Launching Desk is a business-planning tool that combines an AI advisor with tools for tracking tasks, budget, and ideas. Launching Desk does not provide legal, tax, or financial advice, and AI-generated guidance should be independently verified with a qualified professional. In these Terms, "Launching Desk," "we," and "us" refer to the operator of this Service. Our affiliate program has its own terms, on the Affiliates page, which apply to affiliates in addition to these Terms.

2. Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account. We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a security risk to the Service or other users.

You can also start without an email, as a guest. A guest account is kept only in the browser where you started it until you add an email: if you clear that browser's data for this site, use a different browser or device, or log out before adding an email, the guest account and everything in it can't be opened again and can't be recovered. A guest account that hasn't been opened for 30 days is deleted. Guest accounts are on the Free plan, and AI answers for all guest accounts together are limited each day, so they can run out for the day before your own Free credits do; adding an email (free) lifts that shared limit. Paid plans, extra AI credits, business plan purchases and organizations' group plans need an email on your account.

3. Subscriptions and billing

Basic, Premium and Premium+ plans are billed monthly or yearly, depending on the billing period you choose, and automatically renew at the end of each billing period until canceled. A yearly plan renews for another year at the yearly price then in effect. Promotion codes apply only as their offer describes (for example, a discount on the first months of a monthly plan for new customers) and can't be used with yearly billing. All charges are final and non-refundable — including for unused time, partial billing periods, or if you cancel mid-cycle — except where required by applicable law. You can cancel at any time from your account's billing management page (accessible from your account menu once you have an active plan); cancellation takes effect at the end of your current billing period, and you'll retain access to paid features until then. For billing questions, reach us at launchingdeskapp@outlook.com. We'll provide reasonable advance notice before any price change takes effect for existing subscribers.

Each plan includes the AI advisor usage limits shown on our pricing page: on Free, a limit for every 24 hours; on Basic, a limit for every 4 hours; and on Premium and Premium+, a limit for every hour. Basic, Premium and Premium+ also have a monthly limit that resets on the 1st of each month (US Eastern time). Credits are used according to how much each request uses and the AI level you choose for it, so a short question uses less than a long, detailed plan, and Deep and Expert answers use more than Standard ones; your current usage is shown under Usage in the app. Unused plan credits don't carry over.

On any plan, you can also buy extra AI credits as a one-time purchase, in packs at the price shown in the app (currently 1,000 credits for $10). Extra credits are used only once your plan's own credits for the current period or month are used up, and they don't expire or renew. They don't unlock AI levels or tools your plan doesn't include. They belong to your account: they can't be transferred, resold or exchanged for cash, and any left are removed if you delete your account. Like other charges, purchases of extra credits are final and non-refundable except where required by applicable law.

On Free or Basic, you can also buy the business plan for one project as a one-time purchase, at the price shown in the app (currently $29). It covers that project only: writing its plan (up to 5 drafts a day), editing it, downloading it as a PDF and sharing it. Premium and Premium+ include business plans for every project while you're on those plans. A plan you've written stays yours to read, edit, download and share if you change plans, but writing a new draft needs Premium, Premium+ or the purchase for that project. A purchased plan belongs to its project and your account: it can't be moved to another project, transferred or exchanged for cash, and it's removed if you delete the project or your account. Like other charges, it's final and non-refundable except where required by applicable law.

If an organization provides your plan (a group plan), you have that plan while the organization's group plan is active. When it ends, your account moves to Free unless you pay for your own plan. A plan you pay for yourself is billed separately and isn't affected by the group plan.

4. Acceptable use

5. AI-generated content

Launching Desk's AI advisor uses a large language model to generate responses. These responses are AI-generated and may be incomplete, outdated, or factually incorrect — including on legal, tax, licensing, regulatory, and financial topics. The AI advisor is not a lawyer, accountant, financial advisor, or other licensed professional, and using it does not create an attorney-client relationship, an accountant-client relationship, or any other professional relationship. Nothing the AI advisor generates should be treated as legal, tax, financial, or other professional advice.

Business plans are written by the same kind of AI from what you've entered in Launching Desk, and can contain mistakes. Check every part — especially numbers, dates, and legal, tax and licensing details — before you give a plan to a lender, investor or anyone else; you're responsible for what a plan you share or submit says. The Deadline Calendar's federal dates are general dates for businesses whose tax year is the calendar year: they don't account for extensions, disaster relief or your own situation, they aren't tax advice, and a missed reminder email doesn't change a deadline.

By using the AI advisor, you acknowledge that you are interacting with an artificial intelligence system, not a human being. Launching Desk's chat interface identifies itself as an AI advisor at the start of each conversation.

You are solely responsible for independently verifying any AI-generated guidance — especially anything related to business registration, licensing, permits, contracts, taxes, or regulatory compliance — with a qualified, licensed professional before relying on it or acting on it. Using Launching Desk does not guarantee any particular business outcome, result, or level of success.

6. Data and security

We use industry-standard measures — including encryption in transit and access controls — to help protect your account information and data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for using a strong, unique password and keeping your login credentials confidential. If you share a business plan by link, anyone who has the link can see that plan until you turn the link off, so share it only with people you mean to. See our Privacy Policy for more on how your data is handled.

7. Limitation of liability

THE SERVICE, INCLUDING ALL AI-GENERATED CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUNCHING DESK AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR YOUR RELIANCE ON ANY AI-GENERATED CONTENT — INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR DAMAGES ARISING FROM DECISIONS MADE BASED ON AI-GENERATED GUIDANCE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT LIABILITY CANNOT BE FULLY DISCLAIMED UNDER APPLICABLE LAW, LAUNCHING DESK'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.

You agree to indemnify and hold Launching Desk harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your reliance on AI-generated content, or your violation of these Terms.

8. Dispute resolution and arbitration

You and Launching Desk agree to resolve any dispute arising from these Terms or your use of the Service through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court.

YOU AND LAUNCHING DESK EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found unenforceable, the remainder of this arbitration section will not apply to that dispute, and it will instead be resolved in court.

You may opt out of this arbitration agreement by notifying us in writing at launchingdeskapp@outlook.com within 30 days of first accepting these Terms. This section is governed by the Federal Arbitration Act. These Terms and any dispute not subject to arbitration are governed by the laws of Florida, without regard to conflict-of-law principles.

9. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll post a notice on the Service or email the address associated with your account before the changes take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
